B&P prepares international purchase agreements and installation agreements for EPC (engineering-procurement-construction) providers
An international provider of solar power plants commissioned B&P to prepare several model procurement contracts for projects in Germany and abroad. These projects include purchase agreements for modules, power inverters, substructures, and safety and monitoring systems, as well as subcontractor agreements for the installing subsystems.
Our partner Dr Stefan Brass comments: “In order to prepare contracts that are practicable and custom-made to comply with legal requirements, it is necessary to have a precise understanding of the practical requirements of executing major projects in the PV sector. We have acquired this knowledge, above all, from our earlier activities with companies in the sector and continue to deepen our knowledge in our current work. Complex risks of liability can arise from procuring modules from Chinese manufacturers, particularly under the provisions of the European Commission’s Anti-dumping Regulation (Commission Regulation (EU) No 513/2013 of 4 June 2013). Therefore, it is vital to ensure that purchase agreements reflect the provisions of the regulation in order to avoid liability risks.
